Meparsoft Ltd provides software development, web design, and web hosting services to clients worldwide and we have the responsibility to protect every client and provide the best services available. All clients of Meparsoft Ltd are subject to the following terms of service:
You agree to use all Meparsoft Ltd services and facilities at your own risk. Meparsoft Ltd expressly denies any warranties of merchantability and fitness for a particular purpose. In no event shall Meparsoft Ltd be liable for any losses, loss of data, or other commercial damages, including but not limited to special, incidental, consequential, or other damages.
The Client agrees that it shall defend, indemnify, save, and hold Meparsoft Ltd harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney's fees asserted against Meparsoft Ltd, its agents, its customers, officers, and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the client, its agents, employees, or assigns. The Client agrees to defend, indemnify, and hold harmless Meparsoft Ltd against liabilities arising out of any injury to person or property caused by any products sold or otherwise distributed in connection with Meparsoft Ltd's server.
Meparsoft Ltd reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by the client infringing or allegedly infringing on the proprietary rights of a third party. Copyright violation any defective products sold to the client from Meparsoft Ltd's server. Meparsoft Ltd shall be the sole judge of what violates this Policy.
Currently, we bill monthly, quarterly, semi-annually, and annually, depending on the plan, in some cases, for some products, there is no subscription and therefore only one billing is expected. As a provider of tailor-made services, you cannot take advantage of the money-back guarantee.
We accept Visa, Master Card, American Express, Discover Card, and we also accept the PayPal system. For web hosting plans, we will bill your account without any payment. Customers are encouraged to pay by credit card as it is the easiest way to manage payment at this time. There are no contract periods, but for each subsequent period, the contract is automatically renewed unless notified otherwise.
All accounts are billed according to the dates they were first activated on. If you fail to pay for the service renewal within 5 days of deactivation, your account will be suspended. If you fail to pay for the service renewal within 30 days of deactivation, your account will be terminated. You will receive a reminder email 5 days before deactivation.
All services provided by Meparsoft Ltd may only be used for lawful purposes. Transmission, storage, or presentation of any information, data, or material in violation of any United States federal, state, or municipal law is prohibited. This includes, but is not limited to: copyrighted material, material judged threatening or obscene, or material protected by trade secret and other statutes. The subscriber agrees to indemnify and hold harmless Meparsoft Ltd and its employees from any claim arising from the use of the service that damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offensive content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why action was taken. Pornography is prohibited on all Meparsoft Ltd servers. This includes sites that include sexually explicit or hardcore images and/or advertising.
The subscriber acknowledges that the service provided is such that service may be interrupted for many different reasons beyond the control of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, the subscriber agrees that the company shall not be liable for any damages arising from such causes beyond direct and exclusive control of the company.
The subscriber also acknowledges that the company's liability for its negligence cannot in any case exceed an amount equivalent to the charges payable by the subscriber for services during the period in which damages occurred. In no event shall the company be liable for special, consequential, incidental, or punitive damages.
Illegal use in any form, including but not limited to unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Unwanted content some types of content are not allowed on our network. We do not host adult content of any description. Content related to Hacking, Cracking, Warez, and IRC is not allowed. Software, audio, and video downloads can only be hosted if you are the writer and copyright owner of the resources or if you have the right to distribute the materials. Accounts suspended due to content or AUP violations are not refunded under any circumstances.
Meparsoft Ltd shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Meparsoft Ltd's servers going off-line or being unavailable for any reason. Additionally, Meparsoft Ltd shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any website from one of Meparsoft Ltd's servers. All damages shall be limited to the immediate termination of service.
Meparsoft Ltd cannot be held liable for plant stoppages, abnormal stoppages, or data loss. We cannot be held responsible for any profit forecast that a customer would have made if their site was working. Some services provided by Meparsoft Ltd are resold. Therefore, some equipment, routing, software, and programming used by Meparsoft Ltd are not owned or written directly by Meparsoft Ltd. Additionally, Meparsoft Ltd has no responsibility for the use of our customers' accounts. In the event of non-compliance with terms or conditions, the account in question will be automatically deactivated. We reserve the right to remove any account without notice for any reason without refund as Meparsoft Ltd sees fit. FURTHERMORE, Meparsoft Ltd reserves the right to modify any or all of the above policies, guidelines, and disclaimer without notice.
